No Heat in Winter? Know Your Rights in NYC

If you rent: NYC heat season runs October 1 through May 31. During this time, landlords must keep your home at least 68°F in the day and 62°F at night.

If your home is colder than it should be, here are 5 simple steps you can take.

1) Know the heat rules

  • 6 am–10 pm: If it’s below 55°F outside, your home must be at least 68°F inside.
  • 10 pm–6 am: Your home must be at least 62°F inside, no matter the outside temperature.

2) Start a simple “heat log”

If your home is too cold, collect proof:

  • Write down the date and time of each temperature reading.
  • Record inside and outside temperatures.
  • Take a few readings during the day and at night.
  • Note the room where you measured it (try the same spot each time).
  • Write it down right away (don’t wait until later).

3) Reach out to your landlord (and save receipts)

Try to keep your messages in writing (text or email). Save screenshots. If your neighbors are also cold, consider reaching out together.

4) Stay safe while you wait

Plug-in heaters can raise your electric bill and can be a fire risk. If you can, try safer steps like sealing drafts, keeping furniture away from radiators, and closing curtains at night.

5) If heat still isn’t fixed, report it

  • Call 311 and ask to report a heat or hot water violation to NYC HPD.
